News: Summary Judgment Entered in Favor of GNH Client

On January 7, 2015, the Santa Clara Superior Court granted summary judgment based on the statute of limitations in favor of GNH client WSP Flack + Kurtz, Inc. The case involved a claim for more than $30 million arising from the alleged defective design and construction of a domestic hot water plumbing system at the Campus Village Housing at San Jose State University.

After conducting discovery, GNH filed a motion for summary judgment arguing the case was barred by the statute of limitations because documents and testimony revealed plaintiff was suspicious of defects more than five years before filing its lawsuit. The Court granted summary judgment in favor of our client, enabling us to negotiate a settlement—to avoid the risks and costs of an appeal—for a fraction of the amount previously demanded by plaintiff.
