News: GNH Prevails in Class Action Based on California Consumer Privacy Act
In a putative class action lawsuit, plaintiff asserted seven causes of action against GNH’s client, River City Bank, related to an alleged data breach, including a cause of action based on the California Consumer Privacy Act, which provides for statutory damages of $100 to $750 per person affected by certain types of data breaches. In a demurrer to the complaint prepared by GNH partner Patricia L. Bonheyo, GNH persuaded the court to dismiss, with leave to amend, the claims for violation of the California Consumer Privacy Act, bailment, violation of the Unfair Competition Law, and violation of the California Consumer Privacy Act. After the ruling, plaintiff’s counsel agreed to settle the case for a fraction of the potential minimum statutory damages.
